Terms of Use and Privacy Policy for "RAS Cluster Manager" Application

These Terms of Use and Privacy Policy govern your use of the "RAS Cluster Manager" application and the Application Developer's data processing activities.

The creator of the "RAS Cluster Manager" application (hereinafter: "Application" or "software product") is Telecomus IT Solutions Studio (represented by individual entrepreneur Gorbachev A.S., Kyrgyzstan, PIN 22511198450108), hereinafter: "Application Developer" or "Telecomus".

By using applications provided by the Application Developer, you agree to these terms and any subsequent modifications. The Application Developer may update them without prior notice. Always check the current terms here.

The Application Developer is an independent software developer and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with any other companies, platform vendors, or trademark holders.

The "RAS Cluster Manager" application is developed for mobile devices and tablets running iOS, iPadOS, macOS, and Android operating systems.

The Application Developer adheres to the principle that applications released by the "Telecomus" team should not contain advertising integrations, however reserves the right to include advertising materials in its applications.

The Application Developer may regulate at its discretion which versions of the application may be available to users under paid, subscription, or free distribution models.

The Application Developer adheres to transparency, legal requirements, specifics of software product distribution, rules and requirements of countries where the developer's products are technically implemented.

What Data Does the Application Developer Collect?

1. The Application Developer strictly adheres to a Zero-Knowledge local architecture principle. The Application is a specialized administrative utility designed to connect directly from the user's mobile device to the user's server infrastructure via SSH tunnel and the Remote Administration Client (RAC/RAS). The Application Developer DOES NOT request, collect, transmit to developer servers, or store in third-party clouds: server IP addresses, hostnames, ports, operating system passwords, SSH private keys, cluster administrator credentials, infobase passwords, business database records, or active user session data. All server profiles and authentication secrets are encrypted and stored exclusively on the user's local device.
2. The Application Developer receives anonymized diagnostic data through standard mobile platform solutions: Google Play Console, Apple App Store Analytics, or Firebase Crashlytics. When crashes or performance bottlenecks occur, non-identifying telemetry may be recorded: user device model, operating system version, system language, and Flutter runtime error stack traces. The Application Developer cannot and does not set tasks to reveal user identity.
3. The Application Developer uses RevenueCat to manage subscriptions and license purchases. RevenueCat processes an anonymous randomized App User ID, active subscription status (trial, active, expired), purchase timestamp, and expiration date. The Application Developer does not collect, receive, or store bank card numbers, CVC/CVV codes, or payment credentials. Financial transactions are conducted entirely through Apple App Store, Google Play, or designated marketplace in-app purchase systems.
4. Data that becomes available to the developer is anonymized, serves for problem diagnosis and application debugging, and forms the basis for application analytics regarding the following information: application distribution regions, number of application users, frequency of application use by users.
5. The Application Developer records non-identifying user interface preferences stored locally on the user's device, such as selected UI color theme, interface language, and server profile display order.
6. The Application Developer does not collect personal contact lists, user location, or data of other applications on the user's device. The application does not require users to grant special permissions to personal device data.

Data Sharing and Advertising

1. The Application Developer uses data received from users only to the extent necessary for application operation and licensing verification.
2. The Application Developer, in order to comply with the law of the country where the application is distributed, fulfills legal requirements to provide all available information upon request from competent government authorities.
3. The Application Developer does not transfer or sell personal data of application users to advertising companies, brokers, or third parties.
4. The Application Developer does not integrate third-party banner ads or ad-tracking networks into the Application.

User Rights under GDPR and CCPA

1. European Union (GDPR Compliance):
   • Right to Access, Rectification, and Erasure: You have the right to request access to any personal data held about you, correct inaccurate data, or request the deletion of your data ("right to be forgotten").
   • Right to Restriction of Processing and Data Portability: You have the right to request restriction of processing of your data and to receive your data in a structured, machine-readable format.
   • Legal Basis for Processing: The legal grounds for processing minimal technical data are the Developer's legitimate interests (ensuring software stability, debugging, and validating active software licenses) and user consent where explicitly provided.
2. California Residents (CCPA Compliance):
   • No Sale of Personal Information: The Application Developer does not sell, rent, release, disclose, disseminate, make available, transfer, or otherwise communicate personal information to another business or a third party for monetary or other valuable consideration.
   • Right to Know (Past 12 Months): You have the right to request disclosure of the categories and specific pieces of personal information collected about you over the preceding 12 months.
   • Right to Non-Discrimination: The Application Developer guarantees the right to non-discrimination. Exercising your privacy rights under CCPA will never result in altered pricing, discriminatory rates, or denial of application features or service quality.
3. Mechanism for Exercising Your Rights:
   • Local Data: Since the Application stores sensitive infrastructure configurations and credentials strictly locally on your device, you can permanently erase all stored data at any time simply by deleting server profiles within the Application or by uninstalling the Application.
   • Analytics & Diagnostic Identifiers: To request an audit or deletion of anonymous telemetry identifiers (such as RevenueCat App User IDs or crash records), please send a request to info@telecomus.net. Requests will be processed within the statutory deadlines.

Managing Your Data

1. Application users can easily remove all stored server connection parameters, profiles, and keys by deleting server profiles within the Application or by uninstalling the Application using standard device procedures.
2. Most modern devices provide diagnostic and advertising identifiers. Users can independently manage, reset, or limit such identifiers in operating system settings according to device documentation.

Business Transfers

1. Any data collected by the application developer or analytics services may be disclosed as part of any merger, acquisition, or sale/seizure of developer assets.

Children

1. The Application Developer does not use the application to consciously collect data from children under 16 years old and does not conduct marketing activities targeted at them. The software product is intended for IT professionals and system administrators. If a parent or guardian learns that their child has provided data without consent, they should contact the developer at info@telecomus.net. The Application Developer will delete or anonymize such data within reasonable timeframes.

Security

1. The Application Developer cares about maintaining the confidentiality of your data. All sensitive server credentials stored on the user's device are protected by certified OS hardware-backed cryptographic mechanisms (AES-256 GCM encryption via Android KeyStore and Apple Keychain Services). The Application Developer makes every effort to protect user privacy.

Data Retention Policy

1. The Application Developer will store anonymized licensing records for the duration of application use and for a reasonable period thereafter. If you want the application developer to audit its systems for the presence of data about you, you can request such verification at info@telecomus.net with a requirement to delete any information about you. Your request will be reviewed within reasonable timeframes.

Cookies

1. The mobile application itself does not use cookies. Official developer web pages (including this policy page) may use standard cookies to remember visitor preferences such as interface language or theme selection. Users can independently manage or disable cookies via browser settings.

Distribution Model and Refunds

1. The developer's "RAS Cluster Manager" application is distributed through official marketplaces (Apple App Store, Google Play) under a freemium model offering a 3-day full-featured trial followed by subscription tiers ($4,99/month, $29,99/year) or a lifetime purchase ($59,99). The developer reserves the right to distribute specific versions for free.
2. The Application Developer reserves the right to pricing and may modify distribution terms at its discretion, unless otherwise regulated by the distribution platform (marketplace).
3. Software purchases cannot be returned directly to the developer, except in cases required by consumer protection legislation or marketplace rules.
4. Refunds are processed exclusively through the application store where the app was downloaded (Apple App Store or Google Play). Users must submit refund requests directly via the corresponding store platform.
5. The application is not distributed through unauthorized third-party channels except official marketplaces or the developer's verified domains.
6. The Application Developer does not directly accept payment credentials from users. All payments are securely processed by the marketplace in-app purchase systems.
7. If you request a refund, the marketplace may contact the developer to confirm usage status. This information will be used to resolve the refund request.

Store Terms and Intellectual Property

1. Store License Agreements: If you download applications provided by the Application Developer from the App Store, you are subject to the Apple Standard Licensed Application End User License Agreement (EULA). If you download from Google Play, you are subject to the Google Play Terms of Service.
2. Acceptable Use & Intellectual Property: Malicious use is strictly prohibited. All content, features, visual designs, and capabilities of the applications are owned by the Application Developer (Telecomus) and protected by international copyright, trademark, and intellectual property laws. You may not reproduce, modify, distribute, disassemble, reverse engineer, or exploit any part of the applications without explicit prior written permission.

Accessibility

1. The Application Developer strives to ensure the applications are accessible to everyone, including individuals with disabilities. If you encounter any accessibility barriers while using the website or applications, please contact the Application Developer to report them, and all reasonable efforts will be made to promptly address these issues. Ongoing efforts are underway to continually improve accessibility to ensure a seamless experience for all.

Authenticity Verification

1. Only the genuine developer domain https://ras.telecomus.net and official application pages on Google Play and Apple App Store represent authentic channels of this application's developer.
2. Only those pages, groups, channels, and email addresses belong to the application developer that are indicated on the genuine developer website at https://ras.telecomus.net or official store publisher listings.

Application Content, Limitations, and Disclaimer of Liability

1. The "RAS Cluster Manager" application is an administrative tool designed to facilitate remote cluster monitoring and server administration for remote cluster environments. Commands (including session termination, infobase locking, and server profile operations) are executed directly on the user's infrastructure based on user input.
2. Technical Limitations: The Application cannot delete information, cannot physically delete servers or databases, and cannot alter their underlying physical configurations or settings. It functions exclusively as a remote client for monitoring metrics, viewing active sessions, and sending standard operational signals as directed by the user.
3. No Warranty & Backup Recommendation: The Application Developer strives for continuous reliability, but errors may occasionally occur. The Application Developer cannot guarantee uninterrupted or completely error-free operation. For your security and peace of mind, regular backups of your servers and databases are strongly recommended.
4. Disclaimer of Liability: The Application Developer disclaims all liability arising from the use or misuse of the applications. Users assume all risks and consequences associated with their actions. The Application is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. All actions, operations, and commands are performed solely at the user's own risk. The Application Developer is not responsible or liable for any potential data loss, operational interruptions, downtime, or malfunctions in the operation of your software, databases, servers, or any other software products.

Governing Law and Dispute Resolution

1. All disputes, legal claims, controversies, and statutory interpretations arising under or related to these Terms of Use and Privacy Policy, or your use of the Application, shall be governed by and construed in accordance with the laws of the Kyrgyz Republic, without regard to its conflict of law principles.
2. Any dispute that cannot be resolved amicably shall be submitted to and decided exclusively by the competent courts located at the place of the Application Developer's official legal registration in the Kyrgyz Republic.

Changes

1. These Terms of Use and Privacy Policy may be updated periodically. The Application Developer reserves the right not to notify application users individually about minor changes. Updated versions will always be available in the Application and on the official website.
2. Users can always request a previous version of the terms and privacy policy or clarifications of terms used in this policy by writing to the developer.
